Terms & Tips
In short: The game is free, comes as is, and is open source. Tips are optional gifts that unlock nothing. If a tip was a mistake, ask within 60 days and we will refund it.
The game
Tempest Isles is a free browser game made by Driftwood Games, an independent developer. In these terms, “we” means Driftwood Games. By playing, you agree to these terms. There is nothing to buy and nothing to sign up for.
The game is an unofficial, fan-made tribute to Isle Wars Pro by Soleau Software. It is not affiliated with or endorsed by Soleau Software. Its code, map, art and sound are all new. If you hold rights to Isle Wars Pro and have concerns, please email driftwoodgames@proton.me and we will respond promptly.
Source code
The game’s code is open source under the MIT License. That license, not these terms, governs what you may do with the code.
No warranty
The game is provided “as is”, without warranty of any kind. We try to keep it working, but it may have bugs, change, or go offline at any time, and saved scores may be lost (they live only in your browser). To the fullest extent the law allows, we are not liable for any loss or damage arising from your use of the game. Nothing in these terms limits rights you have under consumer law that cannot be waived.
Tips
Tips are completely optional. A tip is a gift to support the game’s hosting and development: it does not buy anything, unlock any feature, or create any obligation for us to keep the game running or add features. Tips are not charitable donations and are not tax-deductible.
Tips are paid through Stripe and appear on your statement as TEMPEST ISLES. See the privacy policy for what details we receive. Tips should only be left by adults or with a parent’s permission.
Refunds
Because a tip buys nothing, there is normally nothing to refund. But if you tipped by mistake, chose the wrong amount, or a child tipped without permission, contact us within 60 days of the tip and we will refund it in full. Refunds go back to the original payment method and usually take 5–10 business days to appear. If a refund cannot go through (for example, the card was closed), we will arrange another way to return it. Please contact us before disputing a charge with your bank; it is faster for you, and a dispute costs the developer a fee.
Contact
For refunds, privacy requests or anything about a tip, email driftwoodgames@proton.me. For bug reports and general questions, open an issue on GitHub (issues are public, so leave out personal or payment details there).
Mods and other versions of the game made by players, and their listing on our community page, are covered by the Driftwood Games terms. The game’s code itself is MIT licensed, as described above.
Changes
If these terms change, we will update this page and its effective date. Changes never apply to tips made before them. These terms are governed by the laws of the State of California, USA.
